1. Introduction
Welcome to SilverHarborBay ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at silverharborbay.site (the "Service") operated by SilverHarborBay.
By securing a booking or utilizing our Service, you consent to these Terms. Should you not agree with any section of these terms, you are prohibited from using the Service.
2. Service Overview
SilverHarborBay offers high-end yacht charter services, which include but are not limited to:
- Yacht hire for the day
- Evening boat rides
- Business team retreats
- Exclusive gatherings
- Extended charters
All offerings are provided subject to availability and weather permitting. Services may be changed or halted at our discretion at any time.
3. Booking and Reservations
3.1 Booking Process
When you wish to book a charter, you must:
- Have at least 18 years
- Supply accurate and complete details
- Remit the mandatory deposit as delineated in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Bookings are only considered confirmed after we receive full payment and send a written confirmation. We retain the discretion to decline service to anyone.
3.3 Availability
Chartering is dependent on the availability of the vessel and favorable weather. We strive to fulfill your requested dates and times to the best of our abilities.
4. Payment Terms
4.1 Pricing
All stated prices are in € and inclusive of any applicable taxes unless mentioned otherwise. Prices are subject to change with no prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter fee is required at the time of booking
- Balance: Must be settled 48 hours before the departure of the charter
- Incidental expenses (if any): Due at the end of the charter service
4.3 Payment Methods
We accept most major credit cards, electronic fund transfers, and certified checks. Payments are securely processed using encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Entire amount refunded minus transaction fees
- Between 24 to 72 hours prior to departure: 50% refund
- Fewer than 24 hours before departure: No refund provided
5.2 Weather Cancellations
Should the weather conditions be deemed unsafe by our captain, we offer the following options:
- Rescheduling the charter to a subsequent available slot at no added cost
- Issuing a full refund when rescheduling is not feasible
5.3 Mechanical Issues
In the unforeseen event of a mechanical failure with the assigned craft, we will make an effort to provide an equivalent alternative. If a suitable alternative is not available, you will be issued a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Each passenger must:
- Adhere to all instructions from the crew
- Use provided safety gear as needed
- Inform us of any health conditions that may influence their safety
- Stay within designated spaces on the vessel
6.2 Prohibited Items
The below-mentioned items are not allowed on board:
- Glassware
- Controlled substances
- Weapons or guns
- Unreasonably large quantities of beverages
- Animals (except if agreed upon in advance)
6.3 Conduct
Passengers are expected to behave in a manner that is respectful. Any charter may be terminated prematurely without refund if the behavior of any passenger poses a threat to safety or interferes with the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is restricted to the cost paid for the charter. We are not accountable for:
- Injuries sustained by passengers due to their own negligence
- Theft or damage to personal belongings
- Any indirect, incidental, or punitive losses
- Delays attributable to weather or situations outside our influence
7.2 Insurance Coverage
We maintain a comprehensive marine insurance policy covering our vessels and business operations. Travelers are responsible for arranging their travel and personal insurance.
7.3 Assumption of Risk
By engaging in our charter services, you recognize that marine activities carry inherent dangers and accept accountability for your safety and actions.
8. Modifications and Itinerary Changes
We retain the authority to adapt itineraries, paths, or schedules due to weather, safety concerns, or operational requisites. Every attempt will be made to offer a comparable substitute experience.
9. Force Majeure
We cannot be held accountable for interruptions, cancellations, or changes due to circumstances beyond reasonable control, which may include but are not limited to:
- Extreme weather phenomena
- Acts of nature
- Regulations imposed by authorities
- Port shutdowns
- Mechanical breakdowns
10. Privacy and Data Protection
Your private data is managed in line with our Privacy Policy. By opting for our services, you agree to the gathering and usage of your data as outlined in our Privacy Policy.
11. Intellectual Property
All the material on our website, such as texts, visuals, emblems, and imagery, is protected by intellectual property laws. Reproduction, dissemination, or creation of derivative works is prohibited without our explicit written consent.
12. Governing Law
The governing laws of Spain shall apply to these Terms. Any disagreements will be settled in courts located in Barcelona, Spain.
13. Changes to Terms
